Balderson, Hageman Lead Effort to Cement Trump Action Against Unconstitutional State Energy Restrictions

WASHINGTON, DC – U.S. Representatives Troy Balderson (OH-12), Chairman of the House Energy Action Team (HEAT), and Harriet Hageman (WY-At-Large) introduced legislation today to codify and make permanent President Donald Trump’s Executive Order Protecting American Energy From State Overreach.

This bill ensures that no state or local government can enforce laws or regulations that undermine U.S. energy production, raise energy costs for Americans, and violate the U.S. Constitution.

“If left unchecked, progressive states’ war on American energy will drive up costs for Ohio families and jeopardize our nation’s energy security,” said Balderson. “I applaud President Trump for taking action through this executive order to defend American energy and stand up to out-of-control climate activists in just a handful of states. This legislation ensures that his efforts will be permanent.”

“America’s energy producers are under assault by radical state and local policies that undermine national grid reliability and energy affordability,” said Hageman. “I am proud to co-lead this legislation to codify President Trump’s executive order and ensure that the federal government uses every tool available to stop unlawful efforts that block responsible energy development. Energy security is national security, and we will not allow ideologically driven bureaucrats at any level of government to cripple American prosperity.”

In recent years, several Democrat-led states have exceeded their constitutional authority by enacting punitive climate policies aimed at domestic energy producers–such as laws that seek to impose retroactive liability on energy companies for greenhouse gas emissions released not only within their borders, but anywhere in the United States—and even around the globe.

President Trump’s executive order, issued on April 8, 2025, directs the Attorney General to review state and local laws that interfere with domestic energy development. If any of these laws are found to be unconstitutional, conflict with federal law, or are otherwise illegal, the Attorney General is required take necessary action to stop their enforcement.
